Activity Participation Release and Waiver of Liability | grace + mae

1. Acknowledgment and Assumption of Risk

I acknowledge that participation in events, programs, classes, workshops, and other activities hosted, organized, sponsored, or facilitated by Grace + Mae and/or its partners may involve certain risks.

I understand that these risks may include, but are not limited to, personal injury, illness, property damage, or death.

By voluntarily participating in these activities, whether on my own behalf or on behalf of a minor for whom I am the parent or legal guardian, I acknowledge and voluntarily assume the risks associated with such participation.

2. Release and Waiver of Liability

To the fullest extent permitted by applicable law, I agree that Grace + Mae, its partners, trustees, officers, directors, employees, agents, representatives, volunteers, and affiliated organizations shall not be held liable for injury, harm, damage, loss, or death arising from participation in activities hosted by Grace + Mae and/or its partners, except to the extent such liability cannot legally be waived.

I voluntarily release and discharge these parties from claims, demands, causes of action, or liabilities arising from my participation or the participation of minors for whom I am the parent or legal guardian, to the fullest extent permitted by Oklahoma law.

3. Indemnification and Hold Harmless

I agree, to the fullest extent permitted by applicable law, to indemnify and hold harmless Grace + Mae, its partners, trustees, officers, directors, employees, agents, representatives, volunteers, and affiliated organizations from claims, actions, damages, expenses, judgments, costs, and reasonable attorneys’ fees arising from my participation or the participation of minors for whom I am the parent or legal guardian.

This provision applies only to the extent permitted by applicable law and does not require indemnification for conduct or liabilities that cannot legally be transferred.

4. Photography, Video, and Media Release

I understand that photographs, videos, or other recordings may be taken during events and activities hosted by Grace + Mae and/or its partners.

I grant Grace + Mae and its authorized representatives permission to use my image, likeness, and voice in photographs, videos, and other promotional materials related to Grace + Mae, including websites, social media, advertisements, and other marketing communications, without current or future compensation.

As the parent or legal guardian of a minor participant, I also grant this permission on behalf of that minor.

This media authorization applies only where legally permitted and may be withdrawn for future uses by submitting a written request to Grace + Mae.

5. Emergency Medical Treatment

I authorize Grace + Mae, its employees, representatives, agents, and event partners to seek or arrange emergency medical care or treatment for myself or any minor participant under my legal guardianship if an injury, illness, or emergency occurs during participation.

I understand that Grace + Mae is not obligated to provide medical services and that emergency medical treatment may be administered by qualified medical professionals.

6. Medical Insurance and Financial Responsibility

I understand and acknowledge that Grace + Mae does not provide health, accident, or medical insurance coverage for participants in its events or activities.

I accept financial responsibility for medical expenses incurred as a result of participation, including emergency medical treatment, ambulance transportation, hospitalization, and other related expenses, to the extent permitted by applicable law.

7. Parent and Legal Guardian Consent

If I am a parent or legal guardian participating in or bringing minors to an event or activity hosted by Grace + Mae and/or its partners, I acknowledge and agree to the following:

1. I am the parent or legal guardian of the minor participant(s) for whom I am accepting this agreement, or I otherwise possess the legal authority necessary to provide consent on their behalf.
2. I have read, understand, and voluntarily accept the terms of this agreement on behalf of myself and the minor participant(s) under my legal guardianship.
3. I authorize the minor participant(s) to participate in activities hosted by Grace + Mae and/or its partners.
4. I acknowledge and accept the risks associated with participation on behalf of myself and the minor participant(s).
5. I agree that the releases, waivers, and other provisions of this agreement apply to myself and, to the fullest extent permitted by applicable law, the minor participant(s) for whom I have authority to provide consent.

By accepting this agreement, I acknowledge that my acceptance applies to myself and all minor participants under my legal guardianship whom I register for or bring to Grace + Mae events and activities.

Nothing in this agreement is intended to waive rights belonging to a minor that cannot legally be waived by a parent or legal guardian.

8. Continuing Agreement and Applicability

This agreement is intended to serve as a general release and waiver of liability applicable to participation in events and activities hosted by Grace + Mae and/or its partners.

Unless otherwise specified in writing, this agreement applies to current and future participation in such activities.

I understand that certain events or activities may require additional waivers, acknowledgments, or consent forms based on the nature of the activity.

9. Governing Law and Severability

I understand and expressly agree that this agreement shall be interpreted and enforced in accordance with the laws of the State of Oklahoma.

If any provision of this agreement is determined to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the extent permitted by applicable law.

This agreement is intended to provide Grace + Mae and its partners with the fullest protection permitted under applicable law.

10. Acknowledgment and Acceptance

By signing, electronically accepting, or otherwise affirmatively agreeing to this waiver in connection with registration or participation, I acknowledge that:

• I have read and understand this Activity Participation Release and Waiver of Liability.
• I voluntarily accept the risks associated with participating in activities hosted by Grace + Mae and/or its partners.
• I agree to the terms of this agreement on behalf of myself.
• If applicable, I am legally authorized to accept this agreement on behalf of the minor participant(s) under my legal guardianship.
• I understand that this agreement may affect certain legal rights, including the right to bring claims against Grace + Mae and other released parties.

My electronic acknowledgment or signature constitutes my acceptance of this agreement to the extent permitted by applicable law when signing up for or attending an event.
